MPs' bombshell letter explodes Home Secretary's claim that law makes him powerless to halt extradition

Alan Johnson was last night told by a powerful group of MPs that he can and must halt the extradition of Gary McKinnon. In a devastating letter, the Home Affairs Select Committee flatly rejected Mr Johnson's claim that he is powerless to intervene.
Gary, who has Asperger's syndrome and is said to be suicidal, is due to be handed over to the U.S. under the controversial Extradition Act. There he faces up to 60 years in jail for hacking into Pentagon and Nasa computers while searching for proof of alien life.
But the Labour chairman of the committee, Keith Vaz, said the 'precarious state' of Gary's mental health meant his removal should be stopped. The letter also calls for a 'comprehensive review' of the entire Extradition Act - which is widely considered imbalanced against British citizens.
It is a stunning vindication for Gary's supporters, and will pile enormous pressure on Mr Johnson to change his stance.
Earlier this year, the Mail presented the Home Secretary with evidence from two leading extradition lawyers stating that he could stop the removal on health grounds. But Mr Johnson - while refusing to publish his own legal advice - stubbornly insisted that this was not the case.
The letter from Mr Vaz - a former minister - to the Home Secretary says: 'We received a clear legal opinion... that the scope for the exercise of discretion by the Home Secretary is greater than you believe. 'Because of Mr McKinnon's precarious state of mental health, the Committee is of the view that he should not be extradited to the U.S.A. and you should exercise your discretion in this case.'
Officially, Mr Johnson has 'stopped the clock' on Gary's removal to the U.S while he considers new medical evidence of the danger he may take his own life if extradited. A decision is expected later this month, but the Home Secretary continues to insist his hands are tied. If he allows the extradition to proceed, he would be flying in the face of evidence from lawyers, autism experts and now one of Parliament's most influential committees.

Very well said Spider. i dont know why Johnson wont put a halt to Gary's extradition.The government seemed happy enough to go against American wishes when it allowed the Scottish executive to free the Libyan bomber Al-Megrahi.

ReplyDeleteThe Pentagon and NASA have been embarrassed beyond belief by Gary's little sortie into and through their highest security but the fact is, he really was only looking for information about the existence of aliens because the very concept totally fascinates him. ReplyDeleteThe extradition treaty as it stands is a total disgrace and is one of the first things Cameron will have to repair, thanks to Bliar's sellout to Bush for his potential future bread of which he is earning a packet.
Let's also not forget that Bliars last "brilliant negotiations"/sellout to Brussels was all about the job he's bought for himself in Brussels! (I sincerely hope he doesn't get it, but nothing would surprise me where that self-serving cunt is concerned!!) O:-)

Hi, Bunni, they have had this poor guy living in torment for seven years. He is absolutely no danger to them, he's just obsessed with UFOs and aliens. He has sauvant syndrome which goes along with Asperger's and autism that's what makes him so brilliant with computers - he did nothing maliciously, he merely did it because he could and he wanted so badly to know. He would never in a million years have imagined the trouble he'd get into because his mind simply doesn't work that way in the first place. If the situation wasn't so tragic it would be a farce! :(

Glad you're feeling better - that's a bit of good positive action and support working for you! I won't say any more here but I will be in touch over the weekend - you know how I am - I like to get it all firmly in my head before I e-mail but and I had some computer problems last night from downloading programmes with a generous helping of trojans and PUPs which I had to get rid of and then everything took a lot longer than I had intended!! I wouldn't be surprised if Labour waits a few months before halting extradition (or at least putting it on indefinite hold, until after the GE) so as to capitalise on it - just as they're now doing with immigration. I.e., trying to turn a negative into a positive.
It looks like business as usual for Labour, Fausty, except this time we can all see straight through them. You are probably right about their tactics in the run-up to the election - the only thing is........who in their right mind would believe a word they say or trust them to carry out their false promises?! You would have to be nuts or stupid to fall for that one again although their ed-you-cay-shun policies are gradually taking care of the stupidity factor!
